Terms of Use
BodySpex provides services to its members (You) subject to
this Terms of Service Agreement (TOS). BodySpex may modify this
TOS from time to time. When there is significant change to this
TOS, BodySpex will notify members.
By using the BodySpex kiosk or accessing the BodySpex web site,
you acknowledge that you have read and understood this Terms
of Service Agreement and the Privacy Policy and agree to be
bound by the terms therein. If you do not agree to the Terms
of Service and Privacy Policy, please do not use the BodySpex
kiosk or BodySpex web site.
The BodySpex Service
BodySpex provides a web site and supporting software (Site)
where members may log in and record certain health and fitness
information, including measurements made at a BodySpex Body
Fat Analysis kiosk (kiosk). BodySpex keeps track of this information
over time and members can track their progress. The BodySpex
web site provides additional features supporting member health
and fitness needs. These features include articles, links to
third-party information, advertising, online forums, and communications
channels to selected health professionals. BodySpex may modify
the set of services offered from time to time.
BodySpex does not dispense medical advice. Some diet or exercise
programs or practices may be inappropriate for certain individuals.
For personal medical questions and before beginning any exercise
or diet program, seek the advice of your health professional.
Use of the BodySpex Site is by paid subscription. A member may
continue to use the Site while their subscription account is
“in good standing.” BodySpex will remind members
when it is time to renew their subscription. If a subscription
account “falls behind” in payment, BodySpex will
temporarily close access to that account holder. If the account
returns to good standing within a month, BodySpex will restore
the member’s historical data with the account. Beyond
a month, BodySpex may not be able to restore historical data.
The BodySpex kiosk uses Bio-electric Impedance Analysis to test
body composition. During the test, a slight electrical current
is passed through the body. Persons with a pacemaker or other
internal electrical device must not use the BodySpex kiosk.
