Privacy Policy
BodySpex collects certain information to serve the needs of our
members (You). This Privacy Policy describes what information BodySpex
collects, how BodySpex (We) may use that information and your rights
regarding the control of that information. This Privacy Policy may
be modified from time to time. When there is significant change
to this Privacy Policy, BodySpex will notify members.
Member Data Privacy
BodySpex understands that body data and other information supplied
by members is personal. BodySpex respects your privacy and is committed
to safeguarding it. BodySpex will keep your Personal Information
private, allowing access only to you. BodySpex will not share your
Personal Information with third parties without your advance consent
unless such release is legally required.
The BodySpex computer systems and staff may analyze usage, values,
and other member data to determine compliance with the TOS and gather
information that will help BodySpex better serve member needs. Such
analysis will remain anonymous until BodySpex suspects a member's
usage is in violation of the TOS, at which point, BodySpex will
take appropriate action.
What Information Do We Collect?
Account Information. Account Information includes your name, address,
email address, billing and other information you provide when signing
up for a BodySpex account. BodySpex will never share your personal
account information with anyone unless you specifically request
us to do so or are required by law.
Body Data. Body Data includes all measurements
made at a BodySpex kiosk. Body Data is private; however, to better
support members achieving their goals, BodySpex allows You to share
body data with a trainer or health professional. (See Sharing Personal
Information for more information.)
Supplied Information. Supplied Information
includes photos you upload and entries in any of the BodySpex tracking
programs--Workout Log, Diet Log, and others. Supplied Information
is private; however, to better support members achieving their goals,
BodySpex allows You to share selected information with a trainer
or health professional. (See Sharing Personal Information for more
information.)
The BodySpex Site allows members to store photos as a record of
fitness progress. Images of the human body represent a special area
of privacy and, in some cases, legal concern. At BodySpex, we are
respectful of the personal nature of body images and your right
to keep them private. Certain BodySpex personnel may access images
to verify compliance with the TOS. (Refer to the TOS for the acceptable
use policy on image uploads.)
Public Submissions. BodySpex may offer areas of
the site where members may submit comments, photos and other information
for open, public, viewing. If you choose to participate in such
an area, any information submitted there is open to public viewing
and will be treated as Public Information. If you submit Personal
Information, such as your e-mail address, in a public area, you
assume all risks relating to the disclosure of that information.
Usage Information. BodySpex collects information
about how you use your account, such as how often you log in and
how much disk space you are using. BodySpex also collects certain
technical information, like your IP address, when you access the
Site. This is necessary to "address" the return communication,
for security, and to help monitor compliance with the TOS. BodySpex
may also compile this information anonymously for statistical purposes.
BodySpex may use cookies in support of our efforts to collect usage
information.
Anonymous Data. BodySpex may use data derived from an anonymous
pool of members. This may include usage information, data values
and trends for groups or members, where the source is not identified
to an individual. BodySpex may use Anonymous Data for statistical
or marketing purposes and may share it with other parties, as BodySpex
sees fit.
Sharing Personal Information
BodySpex is committed to your privacy and health and fitness goals.
To better achieve those goals, BodySpex allows members to share
some of their Personal Information with their Trainer, Nutrition
Analyst, Doctor or other health professional. This is a great way
to get better feedback on methods and progress.
When you decide to share information, you use tools on the Site
to specify Which information to share with Whom. The health professional
must be registered with BodySpex. Registration is a security control
and it requires that health professionals accept our TOS--both of
which help protect your Personal Information. You can share one
or more information sets with one or more health professionals.
At any point, you may use the tools on the Site to change your information
sharing policy. It is your responsibility to control your sharing
policy and keep it current, appropriate to your relationship with
those health professionals.
Data Security
BodySpex has taken appropriate and reasonable steps to protect Personal
Information from unauthorized access or disclosure. The BodySpex
server and web site incorporate a number of security features.
BodySpex kiosks use secure encrypted methods to transmit member
login data and measurements to our server. However, it is possible
that such transmissions may be intercepted or "snooped"
and the encryption defeated. BodySpex kiosks may use wireless communications
(IEEE 802.11) as part of the connection to the BodySpex Server.
Wireless communication increases the risk of transmissions being
snooped.
Access to your private pages (private data) on the Site is controlled
through User and Password authentication. In the event that you
share your User Name and Password with someone else, you are granting
them access to your Personal Information, and BodySpex cannot protect
your information from that access or any consequence that may derive
from it. If you believe someone else has gained access to your
login information, you should inform BodySpex immediately.
Right of Transmission
BodySpex reserves the right to transfer your Personal
Information in the event of a transfer of ownership of the BodySpex
Company. In such case, BodySpex will inform you before the information
is transferred.
